Screen Enclosure for Condominum residents

If you have a screen enclosure and live in a condo, in an area where hurricanes are prevalent, it's wise to check if your screen room is covered should bad weather destroy it

In Florida for example the state Department of Business & Professional Regulation ruled in 2006 that your condo association must pay for your property if it is damaged outside your unit.

Many condo boards felt this ruling was grossly unfair due to the fact that they had no possible way of controlling the destruction caused by bad weather.

On July 2, 2008, the 3rd District Court of Appeal, whose rulings are effective only in Florida's Miami-Dade and Monroe counties, called the department's decision "utterly unfair." The court said everyone shouldn't be responsible for one owner's property.

Condo boards have the support of Florida governor Charlie Crist who signed into law a measure that tries to agree with the court's decision. But unfortunately experts say that Crist's new law has not been drafted well and may only cause more confusion.

It appears that if the condo developer or builder provided and installed the enclosure, then condo owners may have a case in getting the condo corporation to pay for its replacement when damaged in a storm.

Most enclosures though are installed by unit owners themselves and so it is likely they would not qualify for reimbursement from the condo board under existing laws.
